The ground rules of working together
Consignment terms
Last revised: July 2026. These terms govern every consignment agreement between the administrator of rensburg.nl (“the intermediary”) and the consignor of a work. Deviations are valid only when agreed in writing.
Article 1Consignment
The consignor gives the work on consignment for sale. The consignor remains the owner until the work has been sold and paid in full by the buyer. The intermediary acts solely as an agent and does not become a party to the sale between consignor and buyer.
Article 2Acceptance
Acceptance follows an assessment of attribution, condition and saleability. The intermediary may decline a work without stating reasons, or end the consignment early, observing a reasonable notice period.
Article 3Price and commission
The sale or guide price is recorded in writing beforehand. Lowering the guide price takes place only in consultation with the consignor. The intermediary is owed a commission on the net sale price; the commission percentage and any minimum are agreed in writing beforehand. All amounts include VAT where applicable.
Article 4Duration
The agreement is entered into for a period agreed in advance and may subsequently be renewed, unless either party gives timely written notice.
Article 5Insurance and risk
During its stay with the intermediary, the work is insured on the basis of the agreed guide price minus commission; the insurance conditions are available for inspection at the intermediary’s. Damage or loss is reported as soon as it is discovered. For damage not covered, the intermediary’s liability is limited to the amount paid out by the insurance.
Article 6Consignor’s warranties
The consignor declares to be fully entitled to offer the work, that the work is free of third-party rights, and that the information provided on provenance and attribution is correct to the best of their knowledge. The consignor indemnifies the intermediary against third-party claims.
Article 7Sale and payout
After receipt of the full purchase price, the intermediary pays out the sale price minus commission and any agreed costs within the agreed period. If the buyer defaults, the intermediary makes reasonable efforts to obtain payment; the consignor is informed accordingly.
Article 8Unsold work and collection
If the work has not been sold by the end of the term, the consignor collects it within a reasonable period after written notice. Return transport costs are borne by the consignor, unless agreed otherwise. Works not collected after that period may be stored at a charge.
Article 9Costs
Photography, registration and presentation are included in the commission. Extraordinary costs — restoration, third-party expertise, special transport — are incurred only with the consignor’s prior consent.
Article 10Applicable law
Dutch law applies to this agreement. Disputes are preferably settled in consultation; failing that, the competent court in the district of the intermediary’s place of business has jurisdiction.
